Personal Data Processing Policy


1. General provisions


1.1. The KAIN COUTURE Privacy Policy applies to all information that KAIN COUTURE may receive about the User during the use of any of the sites, services, services, programs, products or services, and during the execution of any agreements and contracts with the User by KAIN COUTURE, including the possibility of sending information, including advertising character (hereinafter referred to as Usage).

1.2. The use of the KAIN COUTURE Services, as well as the provision of personal information by the User, means the User's unconditional consent to this Policy and the conditions for processing his personal information specified therein; in case of disagreement with these conditions, the User must refrain from Using.

1.3. KAIN COUTURE assumes that the User initiating the Use consciously determines his requests and controls the technical parameters of the equipment used by him, and has also read this Policy in full. If the User does not agree with the Policy, the Use must be terminated.


2. User's Personal Information


2.1. Within the framework of this Policy, "User's personal information" means:

2.1.1. Personal information that the User provides about himself/herself when registering (creating an account) or in the process of participating in the Use. The information required for the provision of Use is marked in a special way. Other information is provided by the User at his discretion.

2.1.2. Data that is automatically transmitted as a result of Use by the User using the software installed on the User's device, including IP address, cookie data, information about the User's browser (or other program through which access to Use is carried out), technical characteristics of the equipment and software used by the User, date and the access time, the addresses of the requested pages and other similar information.

2.1.3. Other information about the User, the possibility of obtaining which is technically determined.

2.2. KAIN COUTURE does not control and is not responsible for the processing of information by third-party sites to which the User can click on links available on KAIN COUTURE sites, including in search results.

2.3. KAIN COUTURE does not verify the accuracy of the personal information provided by the User and is not able to assess his legal capacity. However, KAIN COUTURE and the User assume that the User provides reliable and sufficient personal information and keeps this information up to date.


3. Purposes of processing the User's personal information


3.1. KAIN COUTURE collects and stores only the personal information that is necessary for the provision / receipt of Use, except in cases where the legislation provides for the mandatory storage of personal information for a period specified by law.

3.2. KAIN COUTURE processes the User's personal information for the following purposes:

3.2.1. Identification of the party within the framework of Use, agreements and contracts with KAIN COUTURE;

3.2.2. Providing the User with the possibility of personalized Use and execution of agreements and contracts;

3.2.3. Communication with the User, including sending notifications, requests and information regarding the Use, execution of agreements and contracts, as well as processing requests and requests from the User, including possible newsletters of an informational nature;

3.2.4. Sending via telecommunication networks, including through the use of telephone, fax, mobile radiotelephone communication (e-mail, telephone, etc.) in order to carry out promotional and informational mailings containing information about discounts, upcoming and current promotions, other events of KAIN COUTURE and its partners. The user has the right to refuse to receive advertising and other information without explaining the reasons for refusal by informing KAIN COUTURE in any way convenient for the user;

3.2.5. Improving the quality of Use, convenience, development of new features and use options;

3.2.6. Targeting of advertising materials;

3.2.7. Conducting statistical and other research based on depersonalized data.

3.3. KAIN COUTURE has the right to process information about Internet users obtained as a result of information exchange with third parties using the OpenID and OAuth protocols, provided that the latter receive the prior consent of Internet users for the specified processing.


4. Conditions for processing the User's personal information and its transfer to third parties


4.1. With respect to the User's personal information, its confidentiality is maintained, except in cases where the User voluntarily provides information about himself for general access to an unlimited number of persons. When using individual usage options, the User agrees that a certain part of his personal information becomes publicly available.

4.2. KAIN COUTURE has the right to transfer the User's personal information to third parties in the following cases:

4.2.1. The User has agreed to such actions;

4.2.2. The transfer is necessary for the User to use a certain type of Use options or for the execution of a certain agreement or contract with the User;

4.2.3. When the User uses the services and services of companies providing financial services;

4.2.4. The transfer is provided for by Russian or other applicable legislation within the framework of the procedure established by law;

4.2.5. Such transfer takes place within the framework of the sale or other transfer of the business (in whole or in part), while the acquirer assumes all obligations to comply with the terms of this Policy in relation to the personal information received by him;

4.2.6. In order to ensure the possibility of protecting the rights and legitimate interests of KAIN COUTURE or third parties in cases where the User violates the provisions of the current legislation of the Russian Federation in this area, or documents containing the terms of use of specific use options, as well as this document.

4.2.7. As a result of processing the User's personal information by depersonalizing it, depersonalized statistical data may be obtained, which are transmitted to a third party for research, work or services on behalf of KAIN COUTURE.

4.3. When processing personal data of Users, KAIN COUTURE is guided by the Federal Law of the Russian Federation "On Personal Data".


5. Modification and deletion of personal information. Mandatory data storage


5.1. The User can change (update, supplement) the personal information provided by him or part of it at any time.

5.2. The User can also delete the personal information provided by him within a certain account.

5.3. The rights provided for in clauses 5.1. and 5.2. of this Policy may be restricted in accordance with the requirements of the legislation. In particular, such restrictions may provide for the obligation of KAIN COUTURE to preserve the information modified or deleted by the User for a period established by law, and to transfer such information in accordance with the legally established procedure to a public authority.


6. Processing of personal information using cookies and counters


6.1. Cookies available on the User's equipment for any reason can be used by KAIN COUTURE to provide the User with personalized usage options, to target/send information/advertising that is shown to the User, for statistical and research purposes, as well as to improve usage options.

6.2. The User is aware that the equipment and software used for Use may have the function of prohibiting operations with cookies (for any sites or for certain sites), as well as deleting previously received cookies.

6.3. KAIN COUTURE has the right to establish that the provision of certain use options is possible only if the acceptance and receipt of cookies are authorized by the User.

6.4. The structure of the cookie file, its content and technical parameters are determined at the discretion of KAIN COUTURE and may change without prior notice to the User.

6.5. The counters placed by KAIN COUTURE during Use can be used to analyze the User's cookies, to collect and process statistical information and for other purposes. The technical parameters of the counters are determined by KAIN COUTURE and may change without prior notice to the User.


7. Measures applied to protect the User's personal information


7.1. KAIN COUTURE takes necessary and sufficient organizational and technical measures to protect the User's personal information from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, as well as from other illegal actions with it by third parties.

7.2. KAIN COUTURE uses information from the User profile (login and password, security secret question and answer) to authorize access to Use. At the same time, KAIN COUTURE has the right to provide such data to the persons specified in Article 4 of this document. The User is responsible for the safety of this information, including login and password. Any actions performed using it are considered KAIN COUTURE committed by the User. The transfer of the user's own login and password to third parties is prohibited.

If the User has become aware of the login and password of another user, as well as other confidential information about the latter, he is obliged to notify KAIN COUTURE about this and not use the specified information that has become known to him.
